Box3 Motorsport Ltd – Terms and Conditions

By booking with Box3 Motorsport Ltd, you agree to the following terms and conditions. Please read them carefully, as they set out the legally binding terms of your booking.

1. General Terms

1.1 These terms and conditions form a legally binding agreement between Box3 Motorsport Ltd ("we", "us", "our") and you ("the client", "you") for the provision of services.

1.2 By making a payment towards any booking, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full. Payment serves as legal acceptance of this contract.

1.3 This agreement and any dispute arising out of or in connection with it, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

1.4 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising from or connected with this agreement.

1.5 If any provision of these terms is deemed invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.

2. Booking and Payment Policies

2.1 Bookings must be made through our official channels, either via our website or email at support@box3motorsport.com.

2.2 Bookings are only confirmed upon receipt of a 50% non-refundable booking fee, unless otherwise agreed.

2.3 Full payment must be received no later than 14 days before the event. Failure to make full payment by this deadline may result in the cancellation of your booking without notice, and any payments made will be non-refundable.

2.4 Any additional costs, including circuit fees, fuel, damage waivers, or incidental expenses, are the responsibility of the client and must be paid directly to the relevant supplier, unless otherwise agreed.

2.5 The booking fee and final payment must be made via bank transfer only. Credit cards are accepted solely for damage pre-authorisation purposes.

3. Cancellation Policy

3.1 Cancellation fees apply as follows:

• More than 21 days before the event: Full refund of amounts paid, less the non-refundable booking fee.
• 14-21 days before the event: 50% of the total amount paid will be refunded, less the non-refundable booking fee.
• Fewer than 14 days before the event: No refund will be provided.

3.2 If full payment is not received at least 14 days before the event, Box3 Motorsport Ltd reserves the right to cancel your booking without refund.

3.3 In the unlikely event that Box3 Motorsport Ltd must cancel your booking due to unforeseen circumstances, we will endeavour to reschedule or provide a full refund of any amounts paid.

3.4 All cancellations must be made in writing to support@box3motorsport.com.

4. Vehicle Requirements

4.1 All vehicles used on track must be mechanically sound, roadworthy, and comply with circuit regulations.

4.2 It is the participant's responsibility to ensure that their vehicle meets all safety and noise requirements set by the circuit.

4.3 Vehicles must have functioning safety equipment, including seat belts or harnesses, and be free from fluid leaks or mechanical faults that may pose a risk to the driver or other participants.

4.4 Box3 Motorsport Ltd reserves the right to prohibit any vehicle from participating if it is deemed unsafe or does not meet circuit requirements.

5. Driver Requirements

5.1 All drivers must hold a valid, full UK driving licence or equivalent from another country.

5.2 Any driver who does not have an appropriate licence must obtain prior approval from Box3 Motorsport Ltd and may be required to have an ARDS-qualified instructor accompany them.

5.3 Drivers must be in good health and must not be under the influence of alcohol, drugs, or medication that may impair their ability to drive.

5.4 Helmets, gloves, and appropriate protective clothing must be worn at all times while driving on track.

5.5 Box3 Motorsport Ltd reserves the right to refuse track access to any driver who does not meet the requirements listed above.

6. Track Rules

6.1 All participants must attend the driver briefing before going on track. Failure to attend may result in exclusion from the event without refund.

6.2 Overtaking rules and track etiquette must be strictly followed. Dangerous or aggressive driving will result in immediate removal from the event.

6.3 Red and yellow flags must be observed at all times. Failure to adhere to flag signals may result in exclusion from the event.

6.4 Speed limits in the pit lane and paddock areas must be followed.

6.5 Any damage caused to circuit infrastructure (e.g., barriers, curbs, cones) by a participant's vehicle is the responsibility of the participant. The participant will be liable for any repair costs incurred by the circuit operator.

7. Liability

7.1 Box3 Motorsport Ltd accepts no liability for any personal injury, death, damage, or loss suffered by the client or any third party, unless directly caused by our gross negligence or willful misconduct.

7.2 You agree that all risks associated with motorsport activities, including damage to your vehicle or personal injury, are entirely your responsibility. By booking, you accept these risks and agree to indemnify Box3 Motorsport Ltd against any claims arising from your participation.

7.3 Clients are solely responsible for any damage caused to the property, vehicles, or equipment of Box3 Motorsport Ltd or its personnel during their participation in events. You agree to reimburse us fully for any costs incurred as a result of such damage.

7.4 You are responsible for ensuring adequate insurance coverage for all eventualities, including personal injury, vehicle damage, and third-party liability. Box3 Motorsport Ltd does not provide any insurance for clients or their vehicles.

8. Media Rights

8.1 Box3 Motorsport Ltd may capture video footage and images during events for promotional purposes. By participating, you consent to the use of such media in marketing materials, social media, and advertising.

8.2 Participants are permitted to record their own footage for personal use, but any commercial use of images or videos taken at the event must be approved in writing by Box3 Motorsport Ltd.

8.3 If you do not wish to be featured in promotional material, please notify Box3 Motorsport Ltd before the event in writing.

9. Amendments

9.1 We reserve the right to amend these terms and conditions at any time. Updated terms will be posted on our website and will apply to any bookings made after the update.

9.2 By continuing with your booking after an update, you are deemed to have accepted the revised terms.

10. Data Protection

10.1 We collect and process personal data in accordance with applicable data protection laws. For details, please refer to our Privacy Policy, available at box3motorsport.com/privacy-policy.

Final Acknowledgment

By making a payment towards any booking with Box3 Motorsport Ltd, you:

• Confirm that you have read, understood, and agree to these Terms and Conditions in full.
• Acknowledge that payment constitutes acceptance of this contract.
• Agree to be bound by all obligations, liabilities, and conditions outlined in this document.
